Pourtant, il n\u2019est ni obligatoire ni fig\u00e9 dans la m\u00e9thode. D\u00e9cryptage.<br \/>\nNe faites plus l\u2019erreur ! Entretien professionnel et entretien d\u2019\u00e9valuation sont deux choses bien distinctes.<\/p>\n<p>Le premier s\u2019inscrit dans une d\u00e9marche de long terme pour le salari\u00e9. Il s\u2019agit de maintenir son employabilit\u00e9 en envisageant les formations possibles, de d\u00e9finir son projet professionnel, d\u2019\u00e9changer sur ses perspectives d\u2019\u00e9volution dans le poste qu\u2019il occupe, au-del\u00e0 de celui-ci, et m\u00eame de son avenir en dehors de l\u2019entreprise. Il rend compte des apports de l\u2019entreprise au salari\u00e9.<\/p>\n<p>A l\u2019inverse, le second r\u00e9sume les apports du salari\u00e9 \u00e0 l\u2019entreprise. Il recouvre l\u2019\u00e9valuation du salari\u00e9 vis-\u00e0-vis de son incidence sur les r\u00e9sultats, le bilan et les performances de l\u2019entreprise. Non pr\u00e9vu par la loi, il peut \u00eatre rendu obligatoire par une convention collective (c\u2019est le cas pour celle du secteur bancaire ou pour les salari\u00e9s des agences de voyages ou du tourisme). Il peut m\u00eame \u00eatre mis en place de fa\u00e7on unilat\u00e9rale par l\u2019employeur. A retenir, ce droit \u00e0 l\u2019\u00e9valuation rel\u00e8ve du pouvoir de direction de l\u2019employeur, n\u00e9 du contrat de travail et du droit d\u2019\u00e9valuer ses salari\u00e9s en appr\u00e9ciant leurs capacit\u00e9s professionnelles.<\/p>\n<p>Non obligatoire donc, toutefois si l\u2019entreprise d\u00e9cide de mettre en place une politique d\u2019\u00e9valuation des salari\u00e9s, elle est tenue de le faire pour tous. Cette mesure ne peut en effet toucher qu\u2019une partie des effectifs sans courir le risque de devenir une mesure discriminatoire.<\/p>\n<p>Et le CSE dans tout \u00e7a ?<br \/>\nLe CSE doit, de son c\u00f4t\u00e9, \u00eatre consult\u00e9, notamment sur les moyens et techniques d\u2019\u00e9valuation, en amont de la mise en place d\u2019un processus de contr\u00f4le et d\u2019\u00e9valuation. Cette consultation n\u2019a pas \u00e0 \u00eatre r\u00e9it\u00e9r\u00e9e chaque ann\u00e9e, mais le comit\u00e9 social de l\u2019entreprise devra \u00eatre consult\u00e9 \u00e0 nouveau lors de tout changement significatif de m\u00e9thode d\u2019\u00e9valuation (p\u00e9riodicit\u00e9, m\u00e9thode, mesures). En cas d\u2019avis n\u00e9gatif rendu par le CSE, l\u2019employeur n\u2019est toutefois pas tenu de suspendre l\u2019\u00e9valuation, mais il endossera seul la responsabilit\u00e9 des cons\u00e9quences en cas de survenance de risques psychologiques chez les employ\u00e9s.<\/p>\n<p>Sachez que si vous \u00eates membre du CSE, l\u2019\u00e9valuation dont vous pourriez faire l\u2019objet doit \u00eatre la m\u00eame que pour les autres salari\u00e9s de l\u2019entreprise. La Cour de cassation a en effet estim\u00e9 que l\u2018application d\u2019un autre r\u00e9gime d\u2019\u00e9valuation relevait d\u2019une discrimination. Vous ne pouvez pas non plus assister un salari\u00e9 lors d\u2019un entretien d\u2019\u00e9valuation. Cette pr\u00e9rogative ne s\u2019applique, en effet, que lors d\u2019un entretien pr\u00e9alable \u00e0 un licenciement.<\/p>\n<p>Et apr\u00e8s ?<br \/>\nLe salari\u00e9 a un droit d\u2019acc\u00e8s aux donn\u00e9es d\u2019\u00e9valuation qui le concernent. Ne pas lui communiquer pourrait laisser pr\u00e9sumer l\u2019existence d\u2019une discrimination \u00e0 son \u00e9gard. Il est donc libre de demander un copie de son document d\u2019\u00e9valuation. Le salari\u00e9 peut refuser de le signer ou le contester en indiquant ses observations. Pour conclure, il est \u00e0 noter que si cet entretien d\u2019\u00e9valuation peut donner lieu \u00e0 une promotion ou \u00e0 une augmentation, il peut tout aussi fonder un licenciement, sans toutefois remplacer l\u2019entretien pr\u00e9alable \u00e0 un licenciement.
