Il permet \u00e0 la personne de construire sa vie. Alors, quand, pour des raisons ind\u00e9pendantes de sa volont\u00e9, le salari\u00e9 se rend soudain au travail \u00ab \u00e0 reculons \u00bb, parce que la motivation n\u2019est plus l\u00e0, ou, pire, qu\u2019il a peur, il faut agir.<\/span><\/h2>\n<p><span style=\"font-size: 14pt;\"><strong>Aller travailler dans ces conditions n\u2019est pas admissible. Si vous avez, en tant que salari\u00e9, des devoirs, vous avez aussi des droits. Osez vous tourner vers les personnes qui les connaissent et vous aideront \u00e0 les faire respecter.<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Taire votre mal-\u00eatre n\u2019est pas la solution. Le probl\u00e8me persistera. S\u2019il s\u2019agit d\u2019un probl\u00e8me relationnel, il y a de fortes probabilit\u00e9s qu\u2019il d\u00e9g\u00e9n\u00e8re. Surtout, vous taire est dangereux pour votre sant\u00e9. Cela peut engendrer d\u00e9prime, insomnies chroniques, anxi\u00e9t\u00e9\u2026 mais aussi un risque plus \u00e9lev\u00e9 d\u2019accident du travail ou de pathologie lourde. Stop\u2009! Il vous faut r\u00e9agir.<\/span><\/p>\n<h3><span style=\"font-size: 14pt;\">\u00c9tape\u00a01\u00a0: sortir de l\u2019isolement<\/span><\/h3>\n<p><span style=\"font-size: 14pt;\">Le premier pas est toujours le plus dur \u00e0 accomplir. Lieu commun\u2009? Pas le moins du monde. Le plus difficile reste la prise de conscience du caract\u00e8re inacceptable de la situation de travail \u2013 c\u2019est flagrant dans les cas de <b>harc\u00e8lement<\/b> o\u00f9 ce sont bien souvent la famille ou les proches du salari\u00e9 qui lui font r\u00e9aliser la violence de ce qu\u2019il subit. <em>\u00ab\u00a0De quoi avons-nous peur\u2009? \u00bb<\/em>, s\u2019interrogeait ainsi Marie Pez\u00e9, psychologue, initiatrice de la premi\u00e8re consultation \u00ab\u00a0Souffrance au travail\u00a0\u00bb, dans <a href=\"http:\/\/cafes-thema.com\/categorie\/cafes-sante-travail\" target=\"_blank\" rel=\"noopener\">une conf\u00e9rence donn\u00e9e \u00e0 Paris le 26 juin<\/a>. <em>\u00ab Interrogeons-nous sur la mani\u00e8re dont nous avons \u00e9t\u00e9 infantilis\u00e9s, la fa\u00e7on dont cette peur a \u00e9t\u00e9 construite et cette passivit\u00e9 implant\u00e9e pour trouver les moyens de nous en sortir.\u00bb<\/em><\/span><\/p>\n<h3><span style=\"font-size: 14pt;\">\u00c9tape\u00a02\u00a0: rencontrer les bons interlocuteurs<\/span><\/h3>\n<p><span style=\"font-size: 14pt;\">Le tout est d\u2019identifier ensuite les personnes ressources, celles qui vont vous accompagner. Si votre entreprise est pourvue de repr\u00e9sentants du personnel, il vous suffit d\u2019aller \u00e0 leur rencontre. Pourquoi eux\u2009? Parce que, premi\u00e8rement, ils connaissent vos droits. Des droits fix\u00e9s par la convention collective de votre secteur d\u2019activit\u00e9, par la loi. Ils sont les plus \u00e0 m\u00eame de vous \u00e9clairer sur ces points. Et, au-del\u00e0, parce qu\u2019aujourd\u2019hui, en cas de conflit, de souffrance au travail, il est devenu n\u00e9cessaire de ma\u00eetriser les recours \u00e0 la fois juridiques, administratifs et m\u00e9dicaux. Les repr\u00e9sentants du personnel d\u00e9tiennent ces informations. Ils vous indiqueront la d\u00e9marche \u00e0 suivre, pour que vous ne vous perdiez pas dans les m\u00e9andres des proc\u00e9dures, et ils agiront en parall\u00e8le, de concert avec vous.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Par exemple, ils poss\u00e8dent un \u00ab\u00a0droit d\u2019alerte\u00a0\u00bb sur les situations de travail pr\u00e9sentant un danger, physique ou moral, comme sur toute mesure discriminatoire. Ils connaissent le droit du travail\u00a0; ils savent, par exemple, comment et quand d\u00e9clarer un accident du travail. Ils connaissent les termes des accords d\u2019entreprise qu\u2019ils ont peut-\u00eatre n\u00e9goci\u00e9s en qualit\u00e9 de d\u00e9l\u00e9gu\u00e9 syndical. Savez-vous que ce sont les CHSCT (comit\u00e9s d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail), avec l\u2019appui des syndicats, qui ont contribu\u00e9 \u00e0 faire progresser vos droits en obtenant, depuis 2002, une large jurisprudence sur les conflits au travail\u2009?<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Parmi les repr\u00e9sentants du personnel, privil\u00e9giez la CFTC. La raison en est toute simple\u00a0: c\u2019est la seule organisation syndicale qui a fait <a href=\"https:\/\/www.cftc.fr\/fr\/projet-cftc\" target=\"_blank\" rel=\"noopener\"><b>le choix de la personne avant tout<\/b><\/a>. Pas de pr\u00e9requis id\u00e9ologique, donc, mais une \u00e9coute et une adaptation \u00e0 votre situation particuli\u00e8re\u2009; pas d\u2019opposition syst\u00e9matique, criarde et st\u00e9rile, mais la recherche d\u2019un dialogue, \u00e0 d\u00e9faut, d\u2019une r\u00e9solution du probl\u00e8me dans le respect de la dignit\u00e9 de chacun.<\/span><\/p>\n<h3><span style=\"font-size: 14pt;\">Que faire dans une PME, sans repr\u00e9sentants du personnel\u2009?<\/span><\/h3>\n<p><span style=\"font-size: 14pt;\">Ne baissez pas les bras, en vous disant que votre entreprise est trop petite\u2009! Allez chercher le soutien dont vous avez besoin un peu plus loin. Dans votre d\u00e9partement, il existe <a href=\"https:\/\/www.cftc.fr\/fr\/nous-connaitre\/annuaire-des-structures\" target=\"_blank\" rel=\"noopener\"><b>une union CFTC<\/b><\/a>, o\u00f9 des militants vous recevront. Vous pouvez aussi vous adresser \u00e0 la f\u00e9d\u00e9ration CFTC de votre secteur d\u2019activit\u00e9, via le syndicat le plus proche. Dans l\u2019intervalle, n\u2019oubliez pas de demander une consultation \u00e0 votre m\u00e9decin du travail. Il est ind\u00e9pendant de votre entreprise et ce que vous lui direz restera confidentiel. N\u00e9anmoins, ce geste permettra \u00ab\u00a0l\u2019ouverture du dossier\u00a0\u00bb.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Faire appel \u00e0 un syndicat n\u2019est pas une d\u00e9claration de guerre lanc\u00e9e \u00e0 votre employeur, bien au contraire. C\u2019est oser g\u00e9rer une situation de crise ou de mal-\u00eatre, sachant que celle-ci ne se dissipera pas seule et que l\u2019affect n\u2019est pas bon conseiller en la mati\u00e8re.
