{"id":1495,"date":"2018-03-26T11:29:16","date_gmt":"2018-03-26T09:29:16","guid":{"rendered":"https:\/\/cftc-dartyidf.fr\/?p=1495"},"modified":"2018-03-26T11:34:02","modified_gmt":"2018-03-26T09:34:02","slug":"entreprise-condamnee-management-peur","status":"publish","type":"post","link":"https:\/\/cftc-dartyidf.fr\/index.php\/2018\/03\/26\/entreprise-condamnee-management-peur\/","title":{"rendered":"Une entreprise condamn\u00e9e pour son  \u00ab Management par la peur \u00bb"},"content":{"rendered":"<p>La Cour de cassation a rendu une s\u00e9rie de sept arr\u00eats \u00e0 propos de plusieurs salari\u00e9s d\u2019un supermarch\u00e9<br \/>\nqui avaient d\u00e9missionn\u00e9 suite \u00e0 des m\u00e9thodes de management visant \u00e0 les pousser \u00e0 bout.<\/p>\n<p>Les t\u00e9moignages des salari\u00e9s ainsi qu\u2019un rapport de l\u2019inspection du travail ont en effet r\u00e9v\u00e9l\u00e9 qu\u2019avait \u00e9t\u00e9 institu\u00e9 dans l\u2019entreprise un mode de management par la peur allant jusqu\u2019au \u00ab mobbing \u00bb, c\u2019est-\u00e0-dire une forme de harc\u00e8lement collectif, concert\u00e9 contre une personne afin de la mettre \u00e0 l\u2019\u00e9cart et la pousser \u00e0 quitter l\u2019entreprise.<br \/>\nConcr\u00e8tement, ce \u00ab mobbing \u00bb se mat\u00e9rialisait par de l\u2019irrespect, des pressions psychologiques, de l\u2019hyper-surveillance, l\u2019incitation \u00e0 la d\u00e9lation, des r\u00e9primandes vexatoires en public ou en priv\u00e9 et d\u2019autres situations d\u2019isolement. Tel \u00e9tait le quotidien de ces salari\u00e9s dont certains se sont vus d\u00e9clar\u00e9s \u2013 en urgence \u2013 en inaptitude totale par le m\u00e9decin du travail.<\/p>\n<p>L\u2019employeur a \u00e9t\u00e9 condamn\u00e9 par la Cour d\u2019appel de Poitiers \u00e0 verser \u00e0 chacune des sept victimes entre 2000 et 6000 euros de dommages et int\u00e9r\u00eats pour manquement \u00e0 l\u2019obligation de pr\u00e9vention des risques psychosociaux. Tout employeur est en effet d\u00e9biteur envers ses salari\u00e9s d\u2019une obligation de pr\u00e9vention des risques professionnels, l\u2019obligeant \u00e0 prendre toutes les mesures n\u00e9cessaires pour assurer la s\u00e9curit\u00e9 et prot\u00e9ger la sant\u00e9 physique et mentale des salari\u00e9s. Cela peut consister en des actions de pr\u00e9vention des risques professionnels, des actions d\u2019information et de formation, la mise en place d\u2019une<br \/>\norganisation sp\u00e9cifique et de moyens adapt\u00e9s.<\/p>\n<p>Pour contester sa condamnation, l\u2019employeur arguait qu\u2019aucun fait de harc\u00e8lement moral n\u2019avait \u00e9t\u00e9 \u00e9tabli puisqu\u2019il avait \u00e9t\u00e9 relax\u00e9 de ce chef d\u2019accusation lors du proc\u00e8s p\u00e9nal. Mais la Cour de cassation distingue cette obligation de pr\u00e9vention des risques professionnels de la prohibition du harc\u00e8lement moral. Ainsi, il n\u2019est pas n\u00e9cessaire que le harc\u00e8lement moral soit reconnu pour que le non-respect de l\u2019obligation de pr\u00e9vention entra\u00eene une condamnation.<\/p>\n<p>Si le directeur du magasin est, en parall\u00e8le, relax\u00e9 du chef de harc\u00e8lement moral, cela n\u2019emp\u00eache<br \/>\ndonc pas les juges de constater, en s\u2019appuyant sur le rapport de l\u2019inspecteur du travail et<br \/>\nles t\u00e9moignages des salari\u00e9s, que de tr\u00e8s nombreux salari\u00e9s de l\u2019entreprise avaient \u00e9t\u00e9 confront\u00e9s<br \/>\n\u00e0 des situations de souffrance au travail et \u00e0 une grave d\u00e9gradation de leurs conditions<br \/>\nde travail induite par un mode de management part la peur.
