La neige, notamment, peut dans certains cas \u00eatre consid\u00e9r\u00e9e comme un cas de force majeure.<\/span><\/p>\n<div class=\"fig-content__body\" data-component=\"fig-content-body\" data-fgtcs-articlelength=\"\" data-fgtcs-crosslinks=\"Contextuel\">\n<p><span style=\"font-size: 14pt;\"><strong>\u25cf \u00c0 quelles conditions l&#8217;absence pour cause d&#8217;intemp\u00e9rie est-elle admise?<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">La neige, comme le reste des intemp\u00e9ries d&#8217;ailleurs, peut constituer un cas de force majeure. Selon la jurisprudence, l&#8217;\u00e9v\u00e9nement doit \u00eatre impr\u00e9visible, insurmontable et ind\u00e9pendant de la volont\u00e9 de l&#8217;employ\u00e9. En cas de force majeure, le salari\u00e9 ne peut nullement \u00eatre sanctionn\u00e9 pour retard ou absence, notamment si les routes sont impraticables ou si les transports en commun sont bloqu\u00e9s. Si l&#8217;employ\u00e9 ne peut pas faire garder son enfant en raison des intemp\u00e9ries, cela constitue aussi un cas de force majeure, ce qui justifie une journ\u00e9e d&#8217;absence. Si un salari\u00e9 ne peut pas \u00eatre bl\u00e2m\u00e9 pour un retard d\u00fb la neige, cela ne lui donne pas pour autant le droit de partir plus t\u00f4t pour anticiper les difficult\u00e9s de transport.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u25cf\u00a0Quelles cons\u00e9quences sur la r\u00e9mun\u00e9ration?<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">L&#8217;absence pour cas de force majeure ne peut donc pas \u00eatre sanctionn\u00e9e. Cependant, celle-ci peut avoir des cons\u00e9quences sur la r\u00e9mun\u00e9ration du salari\u00e9. Sauf dispositions conventionnelles applicables, l&#8217;employeur n&#8217;est pas tenu de r\u00e9mun\u00e9rer les heures d&#8217;absences. Bien s\u00fbr, la retenue sur salaire doit \u00eatre strictement proportionnelle \u00e0 la dur\u00e9e de l&#8217;absence. \u00c0 noter que les heures perdues peuvent \u00eatre r\u00e9cup\u00e9r\u00e9es ou imput\u00e9es sur les cong\u00e9s pay\u00e9s ou les RTT. Si \u00e0 l&#8217;inverse, le salari\u00e9 se d\u00e9place jusqu&#8217;\u00e0 son lieu de travail et trouve l&#8217;entreprise ferm\u00e9e, l&#8217;employeur se doit de le r\u00e9mun\u00e9rer normalement (sauf en cas de mise en place de ch\u00f4mage partiel).<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u25cf\u00a0Dans quelle mesure peut-on recourir au t\u00e9l\u00e9travail?<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">L&#8217;employeur peut proposer au salari\u00e9 bloqu\u00e9 par les intemp\u00e9ries de travailler de chez lui. En cas de force majeure, cela peut \u00eatre consid\u00e9r\u00e9 comme un am\u00e9nagement du poste de travail. Toutefois, l&#8217;employeur se doit de mettre \u00e0 la disposition du salari\u00e9 tout le mat\u00e9riel n\u00e9cessaire \u00e0 l&#8217;exercice de son activit\u00e9. Si cela n&#8217;est pas mis en place, l&#8217;employ\u00e9 est en droit de refuser d&#8217;effectuer sa journ\u00e9e en t\u00e9l\u00e9travail.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u25cf\u00a0Quels sont les droits des salari\u00e9s travaillant \u00e0 l&#8217;ext\u00e9rieur?<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Pour les professions s&#8217;exer\u00e7ant en ext\u00e9rieur, comme dans le BTP par exemple, l&#8217;employeur se doit de prendre \u00ables mesures n\u00e9cessaires pour assurer la s\u00e9curit\u00e9 et prot\u00e9ger la sant\u00e9 physique et mentale des travailleurs\u00bb, apr\u00e8s avis de la m\u00e9decine du travail, du comit\u00e9 d&#8217;hygi\u00e8ne ou, \u00e0 d\u00e9faut, en accord avec les d\u00e9l\u00e9gu\u00e9s du personnel, pr\u00e9cise le Code du travail. Aucun salari\u00e9 ne peut \u00eatre contraint \u00e0 travailler dans des conditions climatiques trop extr\u00eames, ou mena\u00e7ant directement sa sant\u00e9. S&#8217;il estime que l&#8217;exercice de son travail constitue un danger grave et imminent pour sa sant\u00e9, l&#8217;employ\u00e9 peut user de son \u00abdroit de retrait\u00bb.
