art. 86<\/a><\/em><\/span><\/li>\n<\/ul>\n<\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Constitue une discrimination toute distinction op\u00e9r\u00e9e entre les personnes physiques sur le fondement de leur origine, de leur sexe, de leur situation de famille, de leur grossesse, de leur apparence physique, de la particuli\u00e8re vuln\u00e9rabilit\u00e9 r\u00e9sultant de leur situation \u00e9conomique, apparente ou connue de son auteur, de leur patronyme, de leur lieu de r\u00e9sidence, de leur \u00e9tat de sant\u00e9, de leur perte d&#8217;autonomie, de leur handicap, de leurs caract\u00e9ristiques g\u00e9n\u00e9tiques, de leurs m\u0153urs, de leur orientation sexuelle, de leur identit\u00e9 de genre, de leur \u00e2ge, de leurs opinions politiques, de leurs activit\u00e9s syndicales, de leur capacit\u00e9 \u00e0 s&#8217;exprimer dans une langue autre que le fran\u00e7ais, de leur appartenance ou de leur non-appartenance, vraie ou suppos\u00e9e, \u00e0 une ethnie, une Nation, une pr\u00e9tendue race ou une religion d\u00e9termin\u00e9e.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Constitue \u00e9galement une discrimination toute distinction op\u00e9r\u00e9e entre les personnes morales sur le fondement de l&#8217;origine, du sexe, de la situation de famille, de la grossesse, de l&#8217;apparence physique, de la particuli\u00e8re vuln\u00e9rabilit\u00e9 r\u00e9sultant de la situation \u00e9conomique, apparente ou connue de son auteur, du patronyme, du lieu de r\u00e9sidence, de l&#8217;\u00e9tat de sant\u00e9, de la perte d&#8217;autonomie, du handicap, des caract\u00e9ristiques g\u00e9n\u00e9tiques, des m\u0153urs, de l&#8217;orientation sexuelle, de l&#8217;identit\u00e9 de genre, de l&#8217;\u00e2ge, des opinions politiques, des activit\u00e9s syndicales, de la capacit\u00e9 \u00e0 s&#8217;exprimer dans une langue autre que le fran\u00e7ais, de l&#8217;appartenance ou de la non-appartenance, vraie ou suppos\u00e9e, \u00e0 une ethnie, une Nation, une pr\u00e9tendue race ou une religion d\u00e9termin\u00e9e des membres ou de certains membres de ces personnes morales.<\/span><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<div class=\"titreArt\"><span style=\"font-size: 14pt;\"><strong><span style=\"color: #0000ff;\">Article 225-2<\/span><\/strong><\/span><\/div>\n<div class=\"histoArt\">\n<ul>\n<li><span style=\"font-size: 14pt;\"><em>Modifi\u00e9 par <a class=\"liensArtResolu\" href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do;jsessionid=0555258C1AFB32760C36987C780B283B.tplgfr38s_3?cidTexte=JORFTEXT000033934948&amp;idArticle=LEGIARTI000033938149&amp;dateTexte=20180128&amp;categorieLien=id#LEGIARTI000033938149\">LOI n\u00b02017-86 du 27 janvier 2017 &#8211; art. 177<\/a><\/em><\/span><\/li>\n<\/ul>\n<\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">La discrimination d\u00e9finie aux articles 225-1 \u00e0 225-1-2, commise \u00e0 l&#8217;\u00e9gard d&#8217;une personne physique ou morale, est punie de trois ans d&#8217;emprisonnement et de 45 000 euros d&#8217;amende lorsqu&#8217;elle consiste :<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">1\u00b0 A refuser la fourniture d&#8217;un bien ou d&#8217;un service ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">2\u00b0 A entraver l&#8217;exercice normal d&#8217;une activit\u00e9 \u00e9conomique quelconque ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">3\u00b0 A refuser d&#8217;embaucher, \u00e0 sanctionner ou \u00e0 licencier une personne ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">4\u00b0 A subordonner la fourniture d&#8217;un bien ou d&#8217;un service \u00e0 une condition fond\u00e9e sur l&#8217;un des \u00e9l\u00e9ments vis\u00e9s \u00e0 l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070719&amp;idArticle=LEGIARTI000006417828&amp;dateTexte=&amp;categorieLien=cid\">225-1 <\/a>ou pr\u00e9vue \u00e0 aux articles <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070719&amp;idArticle=LEGIARTI000026264881&amp;dateTexte=&amp;categorieLien=cid\">225-1-1 <\/a>ou <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070719&amp;idArticle=LEGIARTI000033955287&amp;dateTexte=&amp;categorieLien=cid\">225-1-2<\/a> ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">5\u00b0 A subordonner une offre d&#8217;emploi, une demande de stage ou une p\u00e9riode de formation en entreprise \u00e0 une condition fond\u00e9e sur l&#8217;un des \u00e9l\u00e9ments vis\u00e9s \u00e0 l&#8217;article 225-1 ou pr\u00e9vue aux articles 225-1-1 ou 225-1-2 ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">6\u00b0 A refuser d&#8217;accepter une personne \u00e0 l&#8217;un des stages vis\u00e9s par le 2\u00b0 de l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006073189&amp;idArticle=LEGIARTI000006743161&amp;dateTexte=&amp;categorieLien=cid\">L. 412-8 <\/a>du code de la s\u00e9curit\u00e9 sociale.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Lorsque le refus discriminatoire pr\u00e9vu au 1\u00b0 est commis dans un lieu accueillant du public ou aux fins d&#8217;en interdire l&#8217;acc\u00e8s, les peines sont port\u00e9es \u00e0 cinq ans d&#8217;emprisonnement et \u00e0 75 000 euros d&#8217;amende.<\/span><\/p>\n<p>&nbsp;<\/p>\n<div>\n<div class=\"titreArt\"><span style=\"font-size: 14pt;\"><strong><span style=\"color: #0000ff;\">Article 225-3<\/span><\/strong><\/span><\/div>\n<div class=\"histoArt\">\n<ul>\n<li><span style=\"font-size: 14pt;\"><em>Modifi\u00e9 par <a class=\"liensArtResolu\" href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do;jsessionid=0555258C1AFB32760C36987C780B283B.tplgfr38s_3?cidTexte=JORFTEXT000024323102&amp;idArticle=LEGIARTI000024324059&amp;dateTexte=20120430&amp;categorieLien=id#LEGIARTI000024324059\">LOI n\u00b02011-814 du 7 juillet 2011 &#8211; art. 7<\/a><\/em><\/span><\/li>\n<\/ul>\n<\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Les dispositions de l&#8217;article pr\u00e9c\u00e9dent ne sont pas applicables :<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">1\u00b0 Aux discriminations fond\u00e9es sur l&#8217;\u00e9tat de sant\u00e9, lorsqu&#8217;elles consistent en des op\u00e9rations ayant pour objet la pr\u00e9vention et la couverture du risque d\u00e9c\u00e8s, des risques portant atteinte \u00e0 l&#8217;int\u00e9grit\u00e9 physique de la personne ou des risques d&#8217;incapacit\u00e9 de travail ou d&#8217;invalidit\u00e9. Toutefois, ces discriminations sont punies des peines pr\u00e9vues \u00e0 l&#8217;article pr\u00e9c\u00e9dent lorsqu&#8217;elles se fondent sur la prise en compte de tests g\u00e9n\u00e9tiques pr\u00e9dictifs ayant pour objet une maladie qui n&#8217;est pas encore d\u00e9clar\u00e9e ou une pr\u00e9disposition g\u00e9n\u00e9tique \u00e0 une maladie ou qu&#8217;elles se fondent sur la prise en compte des cons\u00e9quences sur l&#8217;\u00e9tat de sant\u00e9 d&#8217;un pr\u00e9l\u00e8vement d&#8217;organe tel que d\u00e9fini \u00e0 <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072665&amp;idArticle=LEGIARTI000006686146&amp;dateTexte=&amp;categorieLien=cid\">l&#8217;article L. 1231-1 du code de la sant\u00e9 publique<\/a> ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">2\u00b0 Aux discriminations fond\u00e9es sur l&#8217;\u00e9tat de sant\u00e9 ou le handicap, lorsqu&#8217;elles consistent en un refus d&#8217;embauche ou un licenciement fond\u00e9 sur l&#8217;inaptitude m\u00e9dicalement constat\u00e9e soit dans le cadre du titre IV du livre II du code du travail, soit dans le cadre des lois portant dispositions statutaires relatives \u00e0 la fonction publique ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">3\u00b0 Aux discriminations fond\u00e9es, en mati\u00e8re d&#8217;embauche, sur le sexe, l&#8217;\u00e2ge ou l&#8217;apparence physique, lorsqu&#8217;un tel motif constitue une exigence professionnelle essentielle et d\u00e9terminante et pour autant que l&#8217;objectif soit l\u00e9gitime et l&#8217;exigence proportionn\u00e9e ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">4\u00b0 Aux discriminations fond\u00e9es, en mati\u00e8re d&#8217;acc\u00e8s aux biens et services, sur le sexe lorsque cette discrimination est justifi\u00e9e par la protection des victimes de violences \u00e0 caract\u00e8re sexuel, des consid\u00e9rations li\u00e9es au respect de la vie priv\u00e9e et de la d\u00e9cence, la promotion de l&#8217;\u00e9galit\u00e9 des sexes ou des int\u00e9r\u00eats des hommes ou des femmes, la libert\u00e9 d&#8217;association ou l&#8217;organisation d&#8217;activit\u00e9s sportives ;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">5\u00b0 Aux refus d&#8217;embauche fond\u00e9s sur la nationalit\u00e9 lorsqu&#8217;ils r\u00e9sultent de l&#8217;application des dispositions statutaires relatives \u00e0 la fonction publique.<\/span><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<p><span style=\"font-size: 14pt;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/\">https:\/\/www.legifrance.gouv.fr\/<\/a><\/span><\/p>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\"><a href=\"http:\/\/www.efficience-santeautravail.org\/\">http:\/\/www.efficience-santeautravail.org\/<\/a><\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Article 225-1 Modifi\u00e9 par LOI n\u00b02016-1547 du 18 novembre 2016 &#8211;
