art. 7<\/a><\/span><\/li>\n<\/ul>\n<\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Aucun salari\u00e9, aucune personne en formation ou en stage ne peut \u00eatre sanctionn\u00e9, licenci\u00e9 ou faire l&#8217;objet d&#8217;une mesure discriminatoire, directe ou indirecte, notamment en mati\u00e8re de r\u00e9mun\u00e9ration, de formation, de reclassement, d&#8217;affectation, de qualification, de classification, de promotion professionnelle, de mutation ou de renouvellement de contrat pour avoir subi ou refus\u00e9 de subir des agissements r\u00e9p\u00e9t\u00e9s de harc\u00e8lement moral ou pour avoir t\u00e9moign\u00e9 de tels agissements ou les avoir relat\u00e9s.<\/span><\/p>\n<div>\n<div class=\"titreArt\"><strong><span style=\"color: #0000ff; font-size: 14pt;\">Article L1152-3\u00a0<\/span><\/strong><\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Toute rupture du contrat de travail intervenue en m\u00e9connaissance des dispositions des articles <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&amp;idArticle=LEGIARTI000006900818&amp;dateTexte=&amp;categorieLien=cid\">L. 1152-1 et L. 1152-2<\/a>, toute disposition ou tout acte contraire est nul.<\/span><\/p>\n<div class=\"titreArt\"><span style=\"color: #0000ff;\"><strong><span style=\"font-size: 14pt;\">Article L1152-4<\/span><\/strong><\/span><\/div>\n<div class=\"histoArt\">\n<ul>\n<li><span style=\"font-size: 14pt;\">Modifi\u00e9 par <a class=\"liensArtResolu\" href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do;jsessionid=17F696662374998C3E65EB0930229AD4.tplgfr24s_1?cidTexte=JORFTEXT000029140364&amp;idArticle=LEGIARTI000029141257&amp;dateTexte=20180126&amp;categorieLien=id#LEGIARTI000029141257\">ORDONNANCE n\u00b02014-699 du 26 juin 2014 &#8211; art. 2<\/a><\/span><\/li>\n<\/ul>\n<\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">L&#8217;employeur prend toutes dispositions n\u00e9cessaires en vue de pr\u00e9venir les agissements de harc\u00e8lement moral.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Les personnes mentionn\u00e9es \u00e0 l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&amp;idArticle=LEGIARTI000006900819&amp;dateTexte=&amp;categorieLien=cid\">L. 1152-2 <\/a>sont inform\u00e9es par tout moyen du texte de l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070719&amp;idArticle=LEGIARTI000006417711&amp;dateTexte=&amp;categorieLien=cid\">222-33-2<\/a> du code p\u00e9nal.<\/span><\/p>\n<div class=\"titreArt\"><span style=\"color: #0000ff;\"><strong><span style=\"font-size: 14pt;\">Article L1152-5<\/span><\/strong><\/span><\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Tout salari\u00e9 ayant proc\u00e9d\u00e9 \u00e0 des agissements de harc\u00e8lement moral est passible d&#8217;une sanction disciplinaire.<\/span><\/p>\n<div class=\"titreArt\"><strong><span style=\"color: #0000ff; font-size: 14pt;\">Article L1152-6<\/span><\/strong><\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Une proc\u00e9dure de m\u00e9diation peut \u00eatre mise en oeuvre par toute personne de l&#8217;entreprise s&#8217;estimant victime de harc\u00e8lement moral ou par la personne mise en cause.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Le choix du m\u00e9diateur fait l&#8217;objet d&#8217;un accord entre les parties.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Le m\u00e9diateur s&#8217;informe de l&#8217;\u00e9tat des relations entre les parties. Il tente de les concilier et leur soumet des propositions qu&#8217;il consigne par \u00e9crit en vue de mettre fin au harc\u00e8lement.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Lorsque la conciliation \u00e9choue, le m\u00e9diateur informe les parties des \u00e9ventuelles sanctions encourues et des garanties proc\u00e9durales pr\u00e9vues en faveur de la victime.<\/span><\/p>\n<\/div>\n<p><strong><span style=\"font-size: 14pt;\">Code p\u00e9nal<\/span><\/strong><\/p>\n<div class=\"titreArt\"><strong><span style=\"color: #0000ff; art. 40<\/a><\/span><\/li>\n<\/ul>\n<\/div>\n<div class=\"corpsArt\">\n<p><span style=\"font-size: 14pt;\">Le fait de harceler autrui par des propos ou comportements r\u00e9p\u00e9t\u00e9s ayant pour objet ou pour effet une d\u00e9gradation des conditions de travail susceptible de porter atteinte \u00e0 ses droits et \u00e0 sa dignit\u00e9, d&#8217;alt\u00e9rer sa sant\u00e9 physique ou mentale ou de compromettre son avenir professionnel, est puni de deux ans d&#8217;emprisonnement et de 30 000 \u20ac d&#8217;amende.<\/span><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<p><span style=\"color: #0000ff;\"><strong><span style=\"font-size: 14pt;\">HARCELEMENT SEXUEL<\/span><\/strong><\/span><\/p>\n<\/div>\n<div class=\"titreArt\"><span style=\"color: #0000ff; <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">2\u00b0 Soit assimil\u00e9s au harc\u00e8lement sexuel, consistant en toute forme de pression grave, m\u00eame non r\u00e9p\u00e9t\u00e9e, exerc\u00e9e dans le but r\u00e9el ou apparent d&#8217;obtenir un acte de nature sexuelle, que celui-ci soit recherch\u00e9 au profit de l&#8217;auteur des faits ou au profit d&#8217;un tiers.<\/span><\/p>\n<div class=\"titreArt\"><span style=\"color: #0000ff;
