L\u2019employeur ne peut donc pas imposer unilat\u00e9ralement le travail de nuit au salari\u00e9, m\u00eame partiellement (Cass. soc. 07\/04\/2004, n\u00b002-41486 ; Cass. soc. 25\/06\/2014, n\u00b0 13-16392 ; Cass.soc.15\/06\/2016, n\u00b0 14-27120). Inversement, il ne peut pas non plus imposer le travail de jour \u00e0 un travailleur de nuit.<br \/>\nLe refus du salari\u00e9 de travailler la nuit n\u2019est donc pas une faute. Cependant, si le changement d\u2019horaires est fond\u00e9 sur un motif \u00e9conomique, il peut entra\u00eener un licenciement \u00e9conomique.<br \/>\nLorsque le travail de nuit est incompatible avec des obligations familiales imp\u00e9rieuses (garde d\u2019un enfant, prise en charge d\u2019une personne d\u00e9pendante..), le refus du salari\u00e9 ne constitue pas une faute ni un motif de licenciement et celui-ci peut demander son affectation sur un poste de jour (art.
