{"id":973,"date":"2017-02-08T16:22:06","date_gmt":"2017-02-08T15:22:06","guid":{"rendered":"https:\/\/cftc-dartyidf.fr\/?page_id=973"},"modified":"2017-02-08T16:26:30","modified_gmt":"2017-02-08T15:26:30","slug":"les-conges-speciaux","status":"publish","type":"page","link":"https:\/\/cftc-dartyidf.fr\/index.php\/les-conges-speciaux\/","title":{"rendered":"Les cong\u00e9s sp\u00e9ciaux"},"content":{"rendered":"<h3>LE CONGE SABBATIQUE<\/h3>\n<p>Les salari\u00e9s peuvent obtenir un cong\u00e9 non r\u00e9mun\u00e9r\u00e9 de 6 \u00e0 11 mois pour se consacrer \u00e0 l\u2019activit\u00e9 de leur choix, \u00e0 condition :<\/p>\n<ul>\n<li>d\u2019avoir au moins 36 mois d\u2019anciennet\u00e9 dans l\u2019entreprise, cons\u00e9cutifs ou non<\/li>\n<li>d\u2019avoir au moins 6 ann\u00e9es d\u2019exp\u00e9rience professionnelle.<\/li>\n<li>de ne pas avoir b\u00e9n\u00e9fici\u00e9 dans les 6 ann\u00e9es pr\u00e9c\u00e9dentes, d\u2019un cong\u00e9 sabbatique, d\u2019un cong\u00e9 pour la cr\u00e9ation d\u2019entreprise ou d\u2019un cong\u00e9 de formation d\u2019une dur\u00e9e d\u2019au moins 6 mois.<\/li>\n<\/ul>\n<h4>LES FORMALITES :<\/h4>\n<p>Le salari\u00e9 doit informer son employeur, par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9c\u00e9ption au moins 3 mois \u00e0 l\u2019avance de la date de d\u00e9part choisie, en pr\u00e9cisant la dur\u00e9e envisag\u00e9e.<\/p>\n<p>La demande de cong\u00e9 sabbatique n\u2019a pas \u00e0 \u00eatre motiv\u00e9e.<\/p>\n<p>L\u2019employeur notifie au salari\u00e9, par lettre remise en main propre contre d\u00e9charge, ou par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception, soit son accord sur la date de d\u00e9part choisie par le salari\u00e9, soit le report (l\u2019employeur peut diff\u00e9rer le d\u00e9part en cong\u00e9 dans la limite de 6 mois), soit son refus motiv\u00e9.<\/p>\n<p>A d\u00e9faut de r\u00e9ponse dans un d\u00e9lai de 30 jours, l\u2019accord est r\u00e9put\u00e9 acquis.<\/p>\n<h4>LES EFFETS DU CONGE SABBATIQUE :<\/h4>\n<p>Pendant la cong\u00e9 sabbatique, le contrat de travail est simplement suspendu, le salari\u00e9 peut pendant cette p\u00e9riode exercer une activit\u00e9 professionnelle r\u00e9mun\u00e9r\u00e9e sous r\u00e9serve de s\u2019abstenir de tout acte de concurrence directe ou indirect \u00e0 l\u2019\u00e9gard de son employeur principal et de respecter les obligations de loyaut\u00e9 et de discr\u00e9tion envers son employeur.<\/p>\n<p>Le non-respect de ces obligations peut justifier le licenciement du salari\u00e9.<\/p>\n<p>A l\u2019issue du cong\u00e9, le salari\u00e9 retrouve son pr\u00e9c\u00e9dent emploi ou un emploi similaire assorti d\u2019une r\u00e9mun\u00e9ration au moins \u00e9quivalente.<\/p>\n<p>Avant l\u2019expiration du cong\u00e9, le salari\u00e9 ne peut invoquer aucun droit \u00e0 \u00eatre r\u00e9employ\u00e9.<\/p>\n<h3>LE CONGE POUR CREATION D\u2019ENTREPRISE<\/h3>\n<p>Apr\u00e8s 2 ann\u00e9es d\u2019anciennet\u00e9 cons\u00e9cutives ou non, le salari\u00e9 peut b\u00e9n\u00e9ficier d\u2019un cong\u00e9 d\u2019une dur\u00e9e d\u2019un an renouvelable sous r\u00e9serve de faire la demande \u00e0 la direction par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception au moins 3 mois \u00e0 l\u2019avance, l\u2019employeur peut reporter la date du d\u00e9part mais ne peut pas refuser ce cong\u00e9.<\/p>\n<h3>LE CONGE PATERNITE<\/h3>\n<p>A chaque naissance, le p\u00e8re qui le souhaite peut, dans les 4 mois qui suivent l\u2019\u00e9v\u00e8nement, b\u00e9n\u00e9ficier du cong\u00e9 de paternit\u00e9 en pr\u00e9venant l\u2019employeur par lettre recommand\u00e9e avec accus\u00e9 d&lt; r\u00e9ception un mois \u00e0 l\u2019avance en pr\u00e9cisant les dates de d\u00e9part et de retour.<\/p>\n<p>La dur\u00e9e du cong\u00e9 est de 11 jours calendaires cons\u00e9cutifs port\u00e9e \u00e0 18 jours en cas de naissances multiples.<\/p>\n<p>Ce cong\u00e9 peut \u00eatre cumul\u00e9 avec les 3 jours ouvr\u00e9s pour naissance.
