Pour appr\u00e9cier si l\u2019opposition a \u00e9t\u00e9 valablement notifi\u00e9e, il faut qu\u2019elle ait \u00e9t\u00e9 re\u00e7ue par les signataires de l\u2019accord dans le d\u00e9lai de 8 jours \u00e0 compter de la date de notification de l\u2019accord. Ainsi, l\u2019opposition \u00e9mise dans le d\u00e9lai de 8 jours mais parvenue apr\u00e8s son expiration n\u2019est pas valable.<\/p>\n<p><em>Cass. soc., 10 janvier 2017, n\u00ba 15-20.335 <\/em><\/p>\n<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div data-accordion class=\"faq-main\">\n\t\t\t\t\t<div data-control class=\"faq-title\">\n\t\t\t\t\t\t<h4>Impossibilit\u00e9 de r\u00e9gulariser \u00e0 posteriori le licenciement notifi\u00e9 verbalement par l\u2019envoi d\u2019une convocation \u00e0 un entretien pr\u00e9alable<\/h4>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div data-content>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"faq-content\"><p>D\u2019apr\u00e8s l\u2019article L1232-6 du code du travail, pour avoir une cause r\u00e9elle et s\u00e9rieuse, le licenciement doit notamment faire l\u2019objet d\u2019une notification \u00e9crite et motiv\u00e9e. Ainsi, un licenciement notifi\u00e9 verbalement est d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse, et ce m\u00eame si l\u2019employeur envoie par la suite au salari\u00e9 une lettre de convocation \u00e0 un entretien pr\u00e9alable.<\/p>\n<p><em>Cass. soc., 10 janvier 2017, n\u00ba 15-13.007<\/em><\/p>\n<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div data-accordion class=\"faq-main\">\n\t\t\t\t\t<div data-control class=\"faq-title\">\n\t\t\t\t\t\t<h4>Le d\u00e9faut de ma\u00eetrise du v\u00e9hicule et l\u2019absence du port de la ceinture de s\u00e9curit\u00e9 par un salari\u00e9 chauffeur professionnel constituent une faute grave<\/h4>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div data-content>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"faq-content\"><p>L\u2019article L4122-1 du code du travail impose \u00e0 chaque salari\u00e9 l\u2019obligation de veiller \u00e0 sa s\u00e9curit\u00e9, en fonction de sa formation et conform\u00e9ment aux consign\u00e9es donn\u00e9es par son employeur. Ainsi, un chauffeur professionnel qui, dans le cadre de son travail, roule \u00e0 une vitesse excessive et ne porte pas sa ceinture de s\u00e9curit\u00e9 peut se voir licencier pour faute grave apr\u00e8s un accident de la circulation dans lequel il a \u00e9t\u00e9 impliqu\u00e9. La violation des obligations d\u00e9coulant de son contrat de travail est en effet d\u2019une importance telle que son maintien dans l\u2019entreprise est impossible.<\/p>\n<p><em>Cass. soc, 15 d\u00e9cembre 2016 n\u00b015-21.749<\/em><\/p>\n<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div data-accordion class=\"faq-main\">\n\t\t\t\t\t<div data-control class=\"faq-title\">\n\t\t\t\t\t\t<h4>Pas de harc\u00e8lement moral entre deux salari\u00e9s exer\u00e7ant leur activit\u00e9 de mani\u00e8re ind\u00e9pendante<\/h4>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div data-content>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"faq-content\"><p>Pour que l\u2019infraction de harc\u00e8lement moral soit caract\u00e9ris\u00e9e, les juges n\u2019exigent pas l\u2019existence d\u2019un lien hi\u00e9rarchique entre la victime et son harceleur. Cependant, pour qu\u2019elle soit reconnue, il faut que les victimes et harceleurs suppos\u00e9s partagent une relation de travail.
